Agreement to Terms

By accessing and using UpBoard ("the Application"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Application.

Use of the Application

Permitted Uses:

  • Managing sales team queues and customer assignments
  • Tracking sales performance and metrics
  • Generating reports and analytics
  • Managing schedules and store operations

User Accounts:

  • You must be invited by an administrator to create an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must provide accurate and complete information
  • You agree to notify us immediately of any unauthorized use of your account

Prohibited Activities

You agree not to:

  • Use the Application for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any portion of the Application
  • Interfere with or disrupt the Application's functionality
  • Copy, modify, or distribute the Application's code without permission
  • Use the Application to transmit malicious code or viruses
  • Harass, abuse, or harm other users
  • Falsify or manipulate sales data or reports

Intellectual Property

The Application and its original content, features, and functionality are owned by UpBoard and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not use our trademarks or service marks without our prior written consent.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UPBOARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES.

The Application is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Application will be uninterrupted, secure, or error-free.

Data Accuracy

While we strive to maintain accurate data, you acknowledge that sales data, reports, and metrics are dependent on user input and system functionality. You are responsible for verifying the accuracy of all data entered into and generated by the Application.

Termination

We reserve the right to terminate or suspend your account and access to the Application immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Application will immediately cease.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Application shall be resolved in the courts located in [Your Jurisdiction].

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Application after such changes constitutes acceptance of the new Terms.
